Welcome to Photo9. We provide personalized photo book creation and printing services. These Terms and Conditions constitute a legal agreement between you and us. By using our website, you acknowledge that you have read, understood, and agree to be bound by these terms in full.

1. Account Requirements

Our services are exclusively available to users who are 18 years of age or older. To access our services, you must create an account on our platform. During registration, you are required to provide accurate and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. We recommend using a strong password and not sharing your login information with others.

2. Content and Storage

Our service enables you to create personalized photo books by uploading and customizing your photos and text. We provide temporary storage of your content for a period of two months from the initial creation date of your photo book project. If no purchase is made within this timeframe, we reserve the right to remove your content from our servers. It is essential that you maintain backup copies of your content, as we are not responsible for permanent storage of unpurchased projects. You must ensure that you have the necessary rights or permissions to use any content you upload to our platform.

3. Prohibited Content

We maintain strict standards regarding acceptable content on our platform. Users are expressly forbidden from uploading or processing any material that contains explicit, violent, or offensive content. This includes, but is not limited to, pornographic material, racially offensive content, graphic violence, or content that promotes illegal activities. Additionally, you must not upload any copyright-protected content without proper authorization or content that violates the privacy rights of others. Photo9 actively monitors uploaded content and reserves the right to report any illegal material to relevant authorities.

4. Pricing and Payment

We display all prices in your local currency and process payments through secure, authorized payment providers. While we strive to maintain consistent pricing, our prices may be subject to change without prior notice. The total cost of your order, including any applicable taxes and shipping fees, will be clearly displayed at checkout. Payment is required at the time of order placement, and we ensure all financial transactions are processed securely.

5. Shipping and Delivery

We are committed to delivering your photo books to the address provided during checkout. While we provide estimated delivery timeframes, these are not guaranteed and may vary based on your location and other factors. The risk of loss transfers to you once we deliver your order to the carrier. It is crucial that you provide accurate shipping information, as we cannot be responsible for deliveries to incorrectly provided addresses. Additional shipping fees may apply based on your location and chosen delivery method.

6. Returns Policy

Given the personalized nature of our photo books, we have a specific returns policy. We accept returns only for products that arrive damaged or defective. If you receive a damaged product, you must notify us within 14 days of receipt, providing photographic evidence of the damage. Our support team will review your claim and arrange for a replacement or refund for valid claims. This policy ensures the quality of our products while recognizing their custom-made nature.

7. Intellectual Property

The content on our website, including designs, logos, and software, is protected by copyright and other intellectual property laws. While you retain all rights to your uploaded photos, you grant us a limited license to process and use these photos specifically for fulfilling your order. This license does not transfer ownership of your content to us. You may not copy, reproduce, or use our website content without explicit written permission.

8. Liability

Our liability is limited to the maximum extent permitted by law. We are not responsible for indirect or consequential losses that may arise from using our services. Our maximum liability in any case is limited to the purchase price paid for your order. However, these limitations do not affect your statutory consumer rights or any other rights that cannot be excluded under applicable law.

9. Service Quality

We provide our services on an "as is" and "as available" basis. While we continuously work to maintain website availability and improve our services, we cannot guarantee uninterrupted access. We regularly update our platform to enhance quality and security. However, we cannot guarantee that our products will meet all subjective expectations, as the nature of custom printing may result in slight variations.

10. Privacy and Data Protection

We take the protection of your personal information seriously, as detailed in our Privacy Policy. All payment processing is conducted using secure encryption protocols. We do not sell your personal data to third parties and maintain strict controls over data access. You have the right to request access to your personal data, and we will provide information about what data we hold about you upon request.

11. Service Termination

In the event we discontinue services in your region, we will provide at least 30 days' advance notice. During this period, you should download or backup any content stored on our platform. Upon service termination, your account and associated data will be deleted from our systems. We cannot provide refunds for unused services after termination, but we will fulfill all orders placed prior to the termination date.

12. Orders

The order process requires careful attention to detail. When placing an order, you must verify all information before confirmation, including shipping and billing details. We reserve the right to refuse orders if they violate our terms or if we suspect fraudulent activity. We will notify you of order acceptance or rejection promptly, and payment is only processed after order acceptance.
